Description | The Rev. Paul Southworth, clerk was seized of estates in Upholland, Orrell and Billing, Lancs., and by his last will and testament he divided those estates between his daughters Catherine and Esther with the remainder of Catherine's portion to Esther and vice versa, 11th September 1758. In 1763 Catherine married Isaac Whyley, and Esther married Robert Lambe in 1768 and died in 1769, without issue, her husband inheriting her moiety, which passed on his death to Woodford Lambe, his brother, and eventually to Mary Ward (nee Lambe). Southworth in his will did not make clear which moiety he intended for which daughter, and litigation ensued. By this deed Whyley agrees to give up all his claim to Esther's portion.
